End User License Agreement

1. Agreement to Terms

These End User License Agreement ("Agreement" or "Terms") govern your access to and use of the Kustom Kreations website, services, and platform (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

2. Eligibility

You must be at least eighteen (18) years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.

3. User Accounts

Certain features of the Services require account registration. When you register, you agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• ●Use the Services for any unlawful purpose or in violation of any applicable law
• ●Upload designs or artwork that infringe the intellectual property rights of any third party
• ●Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Services or its systems
• ●Use automated systems, bots, or scrapers to access the Services without prior written permission
• ●Transmit viruses, malware, or any other malicious code
• ●Use the Services to harass, defame, or harm any other person

5. User Content & Uploaded Designs

You may upload artwork, designs, images, and other content ("User Content") for use in connection with our decoration and printing services. By uploading User Content, you represent and warrant that:

• ●You own or have the necessary licenses, rights, and permissions to use the User Content
• ●The User Content does not violate any law or the rights of any third party, including copyright, trademark, and privacy rights
• ●You grant Kustom Kreations a non-exclusive, royalty-free license to use, reproduce, modify, and display the User Content solely for the purpose of producing, fulfilling, and quality-checking your orders

We reserve the right to refuse any User Content that we believe, in our sole discretion, violates these Terms or applicable law. We are not liable for any damages arising from User Content uploaded by you or other users.

6. Intellectual Property

The Services, including all text, graphics, logos, design templates, software, and platform code, are owned by Kustom Kreations and are protected by United States and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Services without our prior written consent. The Kustom Kreations name, logo, and brand elements are trademarks of Kustom Kreations and may not be used without permission.

7. Services & Orders

Kustom Kreations provides custom apparel decoration services including screen printing, embroidery, direct-to-film (DTF) printing, headwear customization, and promotional products. All orders are subject to acceptance by Kustom Kreations. Quotes provided through the Services are estimates and may be adjusted based on design complexity, quantity changes, material availability, and production requirements. Production timelines are estimates and may vary due to order volume, supply chain factors, and design revisions.

8. Third-Party Services

The Services integrate with third-party providers, including artificial intelligence (AI) tools for artwork analysis and design assistance, and payment processors. We are not responsible for the practices, policies, or actions of these third parties. Your use of third-party services is subject to their respective terms and privacy policies. We do not control and are not liable for how third parties handle your data.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure. We do not warrant the accuracy of quotes, production timelines, or exact color matching. Decorated products may have slight variations in color, placement, and finish due to the nature of the production process.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kustom Kreations and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Services. Our total aggregate liability for any claim arising from or related to these Terms or the Services shall not exceed the amount you paid to Kustom Kreations in the three (3) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kustom Kreations and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, all licenses and rights granted to you under these Terms will immediately cease. You may stop using the Services at any time. Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, and indemnification—shall remain in effect after termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in the State of Oregon. You consent to the personal jurisdiction of these courts.

14. Changes to These Terms

We may update or modify these Terms from time to time. We will post the updated Terms on this page and revise the "Last Updated" date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
